Clay Booking Photos and Release
A booking photograph documents appearance during an identified intake. It must be read with the name, offender or booking number, facility, admission date, and Clay case. Central Regional Jail and Correctional Facility is operated by WVDCR and serves Clay from Sutton in Braxton County. WVDCR may therefore hold the facility-created image even though the arrest arose in Clay. The Clay County Sheriff is the correct custodian only for an arrest or processing image that its own office created.
West Virginia FOIA defines public records broadly and includes photographs within the statutory meaning of a writing. That does not make every image available online or require disclosure of every copy. Juvenile, sealed, expunged, medical, security, investigative, or personal information may be restricted. A booking photo can also remain in a legal or booking file after a name leaves a current custody screen.
Release must be proved separately. A photo says nothing about the later custody outcome. Pair it with the WVDCR release entry, triggering court order, or receiving-agency record. A move to prison, another jail, ICE, or federal custody is a transfer, not community release.

Clay Released Mugshot Sources
Clay has no separate operating county jail and no verified sheriff release gallery or official sheriff mobile app with mugshots. The reliable channels are state corrections details and focused records requests. News and commercial collections may surface copied images, but neither category supplies official proof of release. No commercial mugshot publisher, data broker, or removal service is linked or endorsed.

The public WVDCR Offender Search gateway separates regional-jail and prison searches. That distinction matters. A prison image can be a later offender photograph and not the original Central Regional Jail booking image. A current regional-jail result can show custody at query time, but it is not a list of people who were released.
Note: Match every image to the exact offender or booking number; a shared name is not enough to identify a Clay admission.
No Clay Release Mugshot Gallery
No official Clay County Sheriff recent-release page, rolling mugshot gallery, or sheriff mobile application was found in the research. Clay detainees are served by a state regional facility, so a county sheriff roster is not the expected source. WVDCR offers jail search and Daily Incarcerations, but those tools are custody-oriented. They must not be renamed or treated as a recent-release photo feed.
A photo that appears beside a current jail detail is tied to that record. If the record later disappears, the change does not reveal whether the person posted bond, completed a sentence, transferred, went to court, entered another authority's custody, or left the view after a correction. Use VINE, the Clay docket, and a WVDCR release request to establish the event.
The absence of a gallery also means no official 24-hour or 72-hour photo retention period exists for Clay. The Clay County 24-Hour Release List explains the official fallback for a same-day check. A historic photo request should identify an admission rather than ask for all images within an invented online window.
Request a Clay Booking Photo
A focused request is more likely to reach the right file than a broad demand for a mugshot. WVDCR Policy Directive 151.00 says the legal or booking file can include an Offender Information Report with a photograph, holding and time records, detainers, court orders, discharge documents, and the release checklist. Policy Directive 142.00 identifies the file photograph and many custody fields as public data subject to law and policy.
- Identify the admission. Give the full legal name, date of birth if known, offender or booking number, approximate admission dates, Clay as the arresting or sentencing county, and Central Regional Jail.
- Name the record. Ask WVDCR for the booking photograph or file photograph associated with that admission, not every image under a name.
- Ask for release proof separately. Request the nonexempt release entry or checklist fields showing date, time, type, authority, and receiving agency.
- Request electronic delivery. Ask for a cost estimate before paper copies and accept redaction of exempt parts instead of withholding the whole segregable record.
- Use the sheriff only for sheriff-created images. Send that request to the Clay County Sheriff, P.O. Box 429, Clay, WV 25043, and identify the arrest record.
- Keep the agency response. A denial should state its basis, and a no-record response may show that a different custodian owns the image.
WV Code §29B-1-3 requires reasonable specificity. The custodian must act as soon as practicable and within five days excluding Saturdays, Sundays, and legal holidays by furnishing copies, setting inspection, or giving a written denial. That is a response deadline, not a guarantee that all records arrive within five days. The statute permits actual reproduction cost but not a search or retrieval man-hour fee.
Note: Ask for nonexempt portions and redaction because one protected field does not always require withholding the entire booking-photo record.
Clay Mugshot Publication Limits
WV Code §62-1-6a is a specific booking-photo publication rule. It generally restricts a law-enforcement agency from sharing on social media a booking photograph for an alleged statutory minor offense. Exceptions include a conviction, a fugitive or imminent-threat determination, and a court order that finds a legitimate interest. WVDCR and subordinate organizations are excluded from that section's definition of law-enforcement agency.
The statute also creates a social-media removal route in defined cases. If the agency posted the photograph, it must remove it within 14 days after a qualifying request when charges were dismissed, no indictment was returned, the person was acquitted, or the conviction was reversed, vacated, or nullified. This is not a blanket rule that makes every booking image secret. It also does not automatically erase a WVDCR OIS photograph.
No authoritative statewide commercial pay-to-remove mugshot law was located in the research. That narrow finding should not be turned into a claim that no such rule exists. A payment demand from a private publisher is not an official release field. It has no place in the custody-verification chain, and no removal vendor should be treated as an agency source.
Clay Expungement and Photo Removal
West Virginia expungement law can reach more than an online display. WV Code §61-11-25 addresses qualifying dismissed or acquitted matters and certain completed diversion paths. Its covered record definition expressly reaches photographs, fingerprints, index references, and related electronic or documentary data. Section 61-11-26 governs eligible convictions with its own exclusions and waiting rules.
A valid order must be read for scope. Send it to each agency that holds a covered record and follow the court's process. The Clay clerk can address the court file. WVDCR must handle its own offender and booking records. The sheriff handles only its records. An agency may need time to process the order across systems, but a stale copied image should not be used to reconstruct information that an official custodian no longer makes public.
Social-media removal under §62-1-6a and expungement under §61-11-25 are not the same remedy. One regulates a defined agency posting practice. The other can direct treatment of a broader set of qualifying records. When a photo remains visible after an order, provide the exact order and URL to the official custodian. Do not assume that paying a private party changes the government record.

Verify Clay Mugshots and Release
A sound match combines the photo record with release proof. First, compare the image's offender or booking number, facility, admission, and Clay case. Next, obtain the WVDCR release entry or checklist. Then read the court order that authorized or explains the change. The records answer different questions: the image identifies an intake record, WVDCR establishes custody processing, and the court establishes legal action.
Official news releases can carry images in some cases, but publication is episodic. A news image may concern arrest and say nothing about later release. Third-party collections can be stale, mislabeled, or kept after an expungement. They are at most leads to a name spelling or date. They must never replace the originating agency record.
